Recommendations on the implementation of measures related to the Breach Notification were published

In the process of implementation of the new law "On Personal Data Protection", the service develops recommendations regarding the so-called guidelines regarding legislative innovations.

The recommendations aim, among other things, by referring to specific practical examples, to analyze the legal provision so that the relevant responsible entities fully understand the essence and scope of the obligations assigned to them.

The mentioned recommendations serve to clarify the norms of the Law of Georgia "On Personal Data Protection", promote the establishment of best practices, it does not represent a legal act, it is of a recommendatory nature and does not give rise to additional rights and obligations.

We share with you the recommendation that the Personal Data Protection Service has developed regarding the implementation of measures related to a breach notification that poses a significant threat to basic human rights and freedoms.

Such a mechanism for systematizing information about incidents and informing about them is a novelty in the Georgian legislation on data protection, and its purpose is to help prevent the expected negative consequences for the rights of data subjects because of illegal processing of personal data.

The guideline is open to suggestions and comments and will be updated periodically.
