Workshop on personal data protection issues with participation of judiciary

On December 5-6, 2015 with the initiative of the Office of the Personal Data Protection Inspector and with the support of the International Center for Migration Policy Development (ICMPD) workshop on personal data protection and migration issues was held in Kakheti, hotel “Ambassador Kachreti”. Representatives of the Supreme Court of Georgia, Appeals Court, Tbilisi City Court, representatives of the State Migration Commission and the Office of the Personal Data Protection Inspector were participating in the meeting.

The first part of the meeting was dedicated to the Georgian Law on Personal Data Protection and the activities of the Inspector’s Office. Deputy Inspector, Mr. Nikoloz Bregvadze talked about legal grounds for data processing, data protection principles and specific regulations. He also focused on oversight function of the Inspector over covert investigational activities. Head of the Legal Department Ms. Salome Bakhsoliani and Head of the Inspections Department Mr. Giorgi Mindiashvili presented the functions and mandate of the Office, he discussed the recent decisions of the Inspector and cases of appealed in the court. The particular amount of time was allocated to the citizens’ complaints and rules of Inspection.

Second day of the workshop was fully allocated to the topic of the balance between the freedom of information and personal data protection. Facilitators of the discussion were the Inspector Mrs. Tamar Kaldani, judge of the Supreme Court of Georgia Mr. Nugzar Skhirtladze and Chair of the Tbilisi City Court Mr. Mamuka Akhvlediani. The participants of the workshop discussed the issue of disclosure and publication of the court decisions.

“The workshop was very important and fruitful, judiciary and representatives of our office discussed the data protection legislation. Representatives of our Office talked about our functions and mandate. There is big interest towards our institution and our activities” - mentioned Mrs. Tamar Kaldani.

The chair of the Tbilisi City Court summarized the workshop and mentioned, that “meetings related to the availability of public information, data covering are very important as they will help us to avoid a lot of appealed decisions in the future.”
