The Inspector approved the list of the countries having adequate level of data protection

Personal Data Protection Inspector of Georgia issued the first normative act and identified 47 countries having adequate level of data protection (the so called “White List”). However, before transferring the data to these countries it is necessary to have the respective legal basis for transfer such as for example consent of the data subject.

Different criteria such as ratification of the Convention 108, its Additional Protocol, existence of data protection supervisory authority and appropriate legislation were taken into account while preparing the White List.

The List includes majority of the Council of Europe member states, as well as New Zealand, Australia and Canada..

As a consequence of adoption the White List from September 16, 2014 the transfer of personal data to the countries included therein doesn’t requires the authorization from the Inspector. .

The document is designated for public and private organizations, transferring the personal data abroad.

Transfer of personal data to the countries not included in the White List is possible on the basis of International agreement or prior authorization of the Inspector.
