The Statement of the Personal Data Protection Inspector on Data Processing for Direct Marketing Purposes

On September 1, 2014 Amendments to the Law on Personal Data Protection entered into force. The Amendments along with other issues enhance the regulations on direct marketing.

Starting from today Georgian citizens are enabled to address the companies and request to stop processing of their data for direct marketing purposes at any time with the simplified form. On the other hand, private companies are obliged to stop data processing within 10 working days from citizen's request. They are also obliged to introduce simplified opt-out forms and provide opportunity for citizens to opt-out in the same way as direct marketing was exercised, or to use other affordable and adequate measures, for example provide the phone number or web-site, where it’ll be possible to request to stop sending advertising messages.

From November 1, every Georgian citizen considering that their rights have been violated will be enabled to submit a complaint to the Office of the Personal Data Protection Inspector since the mandate of the Inspector will be fully enacted towards private sector.
