The Mandate of the Personal Data Protection Inspector Extends Over the Law Enforcement Bodies

From September 1, 2014 legal amendments enter into force extending the mandate of the Personal Data Protection Inspector towards law enforcement sector. In addition, the Inspector will supervise data processing in private sector from November 1, 2014.

In order to increase the legitimacy of the supervisory authority the rules of appointment of the Inspector are amended as well. The next Inspector will be elected by the Parliament from the two candidates presented by the Prime-Minister. The candidates will be selected by the Special Competition Commission.

The Amendments enlarge the range of sensitive personal data and the guarantees for the protection of such data are increased. Processing of the genetic data as well as conducting video surveillance in the streets and public places is restricted.

The Amendments also enhance the regulations on direct marketing. From September 1 citizens will be enabled to request companies to stop processing their personal data any time through simplified form. If companies fail to comply with requests, citizens will be entitled to address the Office of the Personal Data Protection Inspector.

The Amendments were adopted by the Parliament of Georgia on August 1, 2014. Amendments are introduced in the Law on Personal Data Protection, seven other laws and Regulations of the Parliament.
