Personal Data Protection Inspector Addresses the Political Parties Concerning the Pre-election Moratorium

On April 14, 2014 the Prime-Minister of Georgia, Mr. Irakli Gharibashvili on the occasion of local self-government elections, announced moratorium regarding exercising legal procedures against persons involved in the election campaign.

The Interagency Commission on Free and Lawful Elections recommended the political parties, election blocks and voters initiative groups taking part in the elections to provide list of the persons involved in the election campaign in order to ensure transparent and fair elections process and achieve the goals of moratorium.

Under to the Law of Georgia on “Personal Data Protection”, the political opinion of a person is the sensitive personal data. The political parties are prohibited from disclosing the data related to their members and activists to the third party without the written consent of this person (Law of Georgia on Personal Data Protection, Article 6.3.).

Personal Data Protection Inspector of Georgia addresses the political parties, election blocks and initiative groups of voters and urges them to inform data subjects and obtain their written consent before their personal data will be disclosed to the Interagency Commission, except the cases when the persons included in the list are officially nominated candidates or made public their involvement in the election campaign.
